Don't Get Fooled by Sovereignty Washing. Separate Architecture from Marketing

As sovereignty moves to the forefront of public-sector procurement, "sovereign" has become one of the industry's most overused terms. The challenge is separating genuine sovereign capabilities from sovereignty washing — claims that rely on contracts and marketing rather than true operational control. The key is to look past the messaging and assess the underlying architecture.

Vendor Claim: "We encrypt all data at rest and in transit."

The Real Question: Who holds the keys? Encryption is a security measure. If the vendor holds the keys, legal compulsion in any jurisdiction produces access. Sovereignty requires the customer to hold cryptographic authority — structurally, not contractually.

Vendor Claim: "Your data never leaves your country."

The Real Question: Under which corporate parent, and subject to which extraterritorial laws? A foreign-headquartered vendor with local servers may still be subject to legal regimes that allow compulsion without a court order visible to the customer.

The Real Question: Is the underlying architecture different, or only the label? Rebranded tiers with additional compliance documentation but unchanged cloud infrastructure and key management are compliance facades, not sovereign architectures.

The Real Question: Does the subsidiary actually operate the service — employing engineers, running build infrastructure, controlling update channels — or does it exist primarily as a contracting layer over a parent-controlled operation?
